Evaluation Process

Remote clear aligner therapy isn't right for everyone. That's why we'll refund your impression kit or 3-D scan, if it's determined you aren't a suitable candidate for clear aligners. This means also not through our more advanced dentist assist treatment with in-office visits. Simply give our customer care team a call after learning about your eligibility to have your refund processed.

Our Techs use a highly accurate 3-D optical camera to capture a digital map of your smile, including your teeth and gum lines. This 3-D image helps us determine if our invisible aligners are a fit for your smile and allows our lab to work with the doctor overseeing your case in creating your personalized treatment plan (SMILEFIE™).

Treatment Process

Yes. Your 3-D setup will be reviewed, modified (if necessary), and approved by a licensed dentist or orthodontist in your area. This ensures your new smile is improved and aligns within the "Standards of Care" for your area.

Yes, after our lab receives your impressions or 3-D scan, we create a custom treatment plan (SMILEFIE™) which shows a before and after 3-D visualization of how your teeth will move with treatment.

Pricing

First, you’d get started with our €29 impression kit or €99 3-D scan. Once your new smile is ready, there are three options: S €799; M €1499 & L €2499. It's mostly about 65% less than our competitors. At the end of treatment, you'll want to purchase extra retainers to stabilize your smile. We sell these for €99 a set.

We accept all major credit cards (Visa, MasterCard, American Express and Discover). For most countries we accept popular local payment options. In selected countries you can pay in installments. Only after approval and acceptance of the online creditcheck.

Other

SMILEDIRECTCLUB® is software that manages your treatment. You can add scans and receive notifications about your treatment progress through the app.

Our minimum age requirement is 12 years old, and patients must have all permanent teeth present. For patients under the age of 18, we need a parent/guardian signature on the Medical/Dental History Form provided during the evaluation step.

Once an order has been made, you must pay the price stated on our website as being the purchase price for the relevant products (subject to the below paragraphs). It is your responsibility to confirm what is in your cart prior to making a purchase. We do not provide refunds for products that are mistakenly purchased. Payment may only be made in the methods provided on our website. We will not ship any ordered products until payment for those products have been received. Unless otherwise stated, the price of our products does not include shipping and handling costs.

By placing an order with us, you warrant and represent to us that:

– You understand the nature and effect of these Terms and agree to be bound by them;
– You are authorised and legally permitted to purchase the products being ordered;

The customer will be notified as soon as is reasonably possible when this occurs and advised on what to do to solve this problem. SmileClub reserves the right to refuse or terminate/cancel orders when there has been website malfunction or error such as technical difficulty, an incorrect price has been displayed, your billing or shipping information is incorrect, we have grounds to believe that you are not authorised or legally permitted to make the relevant purchase, we have grounds to believe that you have breached these Terms or any force majeure events have occurred.

Notification to the customer will be facilitated immediately after this has been notified to us and any payment already received from the customer will be refunded.

Promotions
We may, from time to time, run promotions where certain products, or a combination of products, are offered for sale at a discounted price.

All promotions are subject to availability and while stocks last.

Any products purchased outside of the advertised time frame set out by SmileClub will not be eligible for the promotional price. Where there is no promotion period specified, the relevant promotion will end when it is discontinued on SmileClub’s platforms.

Shipping and Handling Information
All orders placed (other than those placed in peak periods) will be dispatched from our warehouse within 3 business days). In peak periods, please allow for up to 6 business days for dispatch.

Deliveries will be made to the shipping address nominated by you and it is your sole responsibility to ensure that the address provided is complete and accurate.

We are not responsible for delays, lost or damaged shipments or orders sent to incorrect, invalid addresses or correct addresses. In the event that a product is lost in transit, SmileClub will help as much as is reasonably necessary to trace a missing parcel.

Orders may end up being returned to us for various reasons including, non-payment of fees, duties or taxes, incorrect address, unclaimed at post office, etc. If a package is returned or rejected, the customer will need to email support@smileclub.us to arrange redelivery and will also have to pay for all postage costs.

Taxes, Fees and Duties
When, or after delivery is made, there may be fees, duties, import/export and excise taxes, as well as other fees or assessments which may be assessed or levied by any national, State, or local government and any of their departments and subdivisions in relation to the ordered products. These charges are not included in the original shipping charge, and must be paid by you in addition to the amounts stated on our website. You will not be entitled to payment or reimbursement by SmileClub for those charges. If you fail to pay the required fees, duties, taxes or assessments and the items are returned to us, we will provide you with a refund for the returned products minus the return delivery costs.

Subscriptions
We offer a subscription service whereby you may purchase a new set of your chosen SmileClub products to be delivered to your door at the interval provided at the time of purchase on our website.

By purchasing a subscription, you agree to pay an initial and recurring subscription fee at the subscription rate provided at the time you agree to purchase the relevant subscription, and you agree to pay all recurring charges until you cancel your subscription. The subscription payment will be deducted from your nominated account automatically and the product will be sent out as soon as the payment is successful.

It is your responsibility to ensure that you have sufficient funds in your nominated account to satisfy payment for your subscription during each billing period and you agree to reimburse us for any loss or damage suffered by us in connection with your non-payment of the subscription fee.

In the event that payment for any products are overdue, we may cancel or suspend your subscription until payment has been made.

You may cancel your subscription at any time in accordance with the terms of our cancellation policy.

a) Subscription Cancellation
You can cancel your subscription at any time on our website’s account portal or by emailing us at support@smileclub.us with the email address and full name you used to sign up with and our subscription specialist will assist you with this.

Changes to your account will take place from the time SmileClub confirms in written correspondence to you.

Please ensure that you allow three business days for your subscription to be cancelled. Once your subscription fee has been deducted from your account and the order has been shipped, we will not be able to intercept your parcel or provide a refund.

b) Change Subscription Frequency
You can adjust your subscription frequency to one, two or three months at any time on our website’s account portal or by emailing us at subscriptions@SmileClubteeth.com with the email address and full name you used to sign up with and our subscription specialist will assist you with this.

Please note – the maximum frequency between subscription orders is three months.

Changes to your account will take place from the time SmileClub confirms the change in written correspondence to you.

c) Change Subscription Products
You can change the products you are receiving in your subscription at any time on our website’s account portal or by emailing us at subscriptions@SmileClubteeth.com. You may add or remove items, which may affect the subscription fee payable.

To do this, simply email subscriptions@SmileClubteeth.com with the email address and full name you used to sign up with and our subscription specialist will assist you with this.

Changes to your account will take place from the time SmileClub confirms in written correspondence to you.

Returns Policy
If you consider that an item is defective and you are entitled to a replacement or a refund, you must first email support@smileclub.us and describe your problem.

Results will vary greatly from person to person, depending on the type of teeth or conditions of teeth/stains the user has. It may take a number of months to completely rid your teeth of tough stains. We here at SmileClub are not able to refund purchases unless the product is defective.

Subject to the below paragraph, SmileClub will offer a refund for defective items only if the defective product is returned to us, or you provide us with a video demonstrating (to our satisfaction) that the product is defective, within 30 days of your receipt of the same. We will review your claim as soon as we can and, if we are satisfied that your product is defective, we will provide you with a refund for the defective product.

We offer a five (5) year warranty for our LED lights. If, at any time within five (5) years following your receipt of the LED light, it no longer works for any reason and you have used it in accordance with our instructions, we will provide you with a replacement LED light free of charge. To make a claim under this warranty, you can either return the LED light to us, or provide us with a video demonstrating how the LED light is no longer working, within five (5) years from the date that you received it. We will review your claim as soon as we can and, if we are satisfied that the LED light is no longer working, we will send you a new LED light.

If you elect to return the defective product to us, it is your responsibility to pay for shipping costs upon return. Refund will be limited to the cost of the item being returned via regular post, not express. An item returned via express is the responsibility of the user and a partial refund of only the actual regular mail will be refunded. It is the user’s responsibility to be aware of this.

Limitation of Liability
To the maximum extent permitted by the applicable law:

we do not make any warranties or representations other than those expressly set out in these Terms; and all terms, representations and warranties that may be excluded by law regarding our products and the provision of them are expressly excluded from these Terms.
If any legislation implies into these Terms any term or warranty and also prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under, that term or warranty, is deemed to be included in these Terms.

To the maximum extent permitted by the applicable law, we expressly exclude liability for any:

indirect, special, incidental, or consequential loss or damage suffered by you which may arise in connection with these Terms, or the provision of our products, their use, or in respect of other equipment or property; loss, damage or expense that you may incur or suffer (as the case may be) as a consequence of any act or omission of any third party service provider; and loss of profit, business, revenue, goodwill or anticipated savings.
If any legislation or law implies into these Terms any term or warranty and also prohibits provisions in a contract excluding the application or exercise of that term or warranty then, to the maximum extent permitted by law, our liability for a breach of such a term or warranty will be limited, at our sole option, to any one or more of the following:

the supplying of our products again; or the payment of the cost of having the products supplied again. To the maximum extent permitted by law, if for any reason we are directly or indirectly liable to you in respect of any products provided, our maximum aggregate liability in respect of all claims made by you will be the amount charged by us in respect of those products.

Dispute Resolution
Unless otherwise specifically provided in these Terms, a party to these Terms must not commence court proceedings, save for proceedings seeking interlocutory relief, in respect of a dispute arising out of these Terms unless it has complied with the provisions of the below dispute resolution process.

A party must give the other a notice (dispute notice) setting out: what the party considers is in dispute; and what that party requires to be done to resolve the dispute and the grounds it has for those requirements.
If the dispute is not resolved within five (5) business days of delivery of the dispute notice, the parties must, within two (2) business days, appoint a mediator approved by both parties or a mediator appointed by the President of the Queensland Law Society. The parties must ensure that the mediation is held and concluded within 15 days of the appointment of the mediator.

Evidence of anything said or done in the course of attempting to settle a dispute is not admissible in any subsequent proceedings.

During the dispute resolution process the parties must continue to act in accordance with these Terms.

If the dispute is not resolved by mediation within 30 days of the delivery of the dispute notice then either party may terminate the mediation.

Costs associated with the appointment of a mediator shall be borne equally between the parties to the dispute.

Subject to the above paragraph, each party must pay its own legal costs and disbursements connected with the dispute.

Intellectual Property
Except to the extent owned by our suppliers or licensors, we own all Intellectual Property Rights subsisting in our website, our products and our branding. Nothing in these Terms or our website in any way grants you any right or entitlement of whatever nature in respect of our Intellectual Property Rights.

We reserve all rights, title and interests in our Intellectual Property Rights.

For the purposes of this paragraph, Intellectual Property Rights means intellectual property rights conferred by statute, common law or equity in any part of the world including (without limitation) patents, trademarks, copyright and neighbouring rights, designs, domain names, know how, circuit layouts, moral rights, rights in get-up, inventions and other results of intellectual activity in the industrial, commercial, scientific, literary or artistic fields, whether registered or not, and all other rights of a like nature which are now or may in the future subsist or be conferred in relation to them by the law in force in any part of the world, including all renewals and extensions.

General
With the exception of those terms provided on our website, these Terms contain the entire agreement between the parties hereto and no representations, inducements, promises or agreements oral or otherwise not embodied herein shall have any force or effect other than as expressly provided in this document or subsequent to the date hereof in writing and signed by a proper and duly authorised representative of the party to be bound thereby.

If any provision of these Terms are prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these Terms and rendered ineffective as far as possible without modifying the remaining provisions of these Terms, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms.

These Terms are governed by and is to be construed in accordance with the Laws of Republic of Ireland.

Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of Republic of Ireland.

Any failure or delay by us to exercise a power or right does not operate as a waiver of the power or right. The exercise of power or right does not preclude either its exercise in the future or the exercise of any other power or right. A waiver is not effective unless in writing. A waiver of a power or right is effective only in respect of the specific instances to which it relates and for the specific purpose for which it is given.

You must not assign your rights or obligations pursuant to these Terms to any other person without our prior written consent.

Clear aligners
Successful cosmetic dental treatment is a partnership between the doctor and the patient. As a general rule, informed and cooperative patients can achieve positive alignment results. While recognising the benefits of a beautiful healthy smile, you should also be aware that, as with all cosmetic, healing dental treatment, there are limitations and potential risks. These are seldom serious enough to indicate that you should not have treatment. Please read this information carefully. Ensure you know what is expected of you as the patient (or as the parent/guardian of a young patient) during treatment. Clear aligners treatment is an orthodontic treatment in which the patient wears a series of clear, removable aligners that gradually move the teeth to improve bite function and/or aesthetic appearance. This treatment is intended to provide the end benefits of traditional “wired”, “metal” brace treatment, such as straight teeth and improved bite function, as well as the following benefits that are only available when going wireless:

The clear aligners are clear, so people may not even notice you wearing them.
There are no cuts or abrasions from wires or brackets, so clear aligners are more comfortable than traditional braces.

The clear aligners are removable, allowing you to eat, drink, brush and floss with freedom.
Although the benefits generally outweigh the potential risks, all factors should be considered before making the decision to wear clear aligners. If you choose to undergo clear cosmetic aligner treatment with SmileClub, we will manufacture clear aligners customized for your teeth based on your dentist’s prescription. The dentist is responsible for delivering and managing your care. Potential risks of clear aligners are as follows:

• Treatment time may exceed estimates.
• Poor compliance with your dentist’s instructions, wearing clear aligners less than 22 hours per day, excessive bone growth, poor oral hygiene can lengthen treatment time, increase the cost, and affect the quality of the end results.
• Unusually shaped teeth can also extend treatment time and affect results. For instance, short clinical crowns can cause problems with aligner retention and slow or prevent teeth movement.
• Tooth decay, periodontal disease, decalcification (permanent markings on the teeth), or inflammation of the gums may occur if proper oral hygiene and preventative maintenance are not maintained, whether wearing clear aligners or otherwise.
• Sores and irritation of the soft tissue of the mouth (gums, cheeks, tongue and lips) are possible but rarely occur due to wearing clear aligners.
• Initially, the clear aligners may temporarily affect your speech. Patients generally adapt quickly to wearing aligners and it is rare that speech is impaired for an extended period of time.
• While wearing clear aligners, you may experience a temporary increase in salivation or dryness of the mouth. Certain medications can increase this.
• Any medications you may be taking and your overall medical condition can affect your dental treatment.
• Though uncommon, allergic reactions to the material used during treatment may occur. If you believe you are experiencing an adverse reaction, inform your dentist immediately.
• Tooth sensitivity and tenderness of the mouth may occur during treatment—especially when advancing from one aligner to the next.
• Bone and gums, both of which support the teeth, can be affected by wearing clear aligners. In some cases, their health may be impaired or aggravated.
• Wearing clear aligners may aggravate teeth—previously traumatized or not.
• Existing dental restorations, such as crowns and bridges, may be affected by wearing clear aligners. They may become dislodged and require re-cementation or in some instances, replacement. Before any dental restorations are replaced or added, consult your dentist, as they can affect the way your clear aligners sit.
• Teeth may supra-erupt (come out of the gums more than other teeth) if not at least partially covered by the clear aligner.
• Root resorption (shortening) can occur during any type of orthodontic treatment, including clear aligners. Shortened roots are of no disadvantage under healthy conditions. In rare cases, root resorption can result in loss of teeth.
• In cases of severe crowding or multiple missing teeth, it is more likely that the aligner may break. Contact your dentist as soon as possible if this occurs.
• Because orthodontic appliances are worn in the mouth, accidentally swallowing or aspirating the aligner—in whole or in part—may occur.
• Though rare, problems may occur in the jaw joint, causing joint pain, discomfort, headaches or ear problems. Inform your doctor of any such problems immediately.
• Clear aligners worn out of their intended sequence can delay treatment results and result in complications including (but not limited to) patient discomfort. Always wear clear aligners in the order specified by your doctor.
• In some cases, a “black triangle” of missing gingival tissue may be visible below the interproximal contact when teeth are aligned after being overlapped for an extended period of time.
• Results may relapse if proper retainer wear is not followed as directed by your doctor.
• A successful treatment outcome cannot be guaranteed. After the customised clear aligners have been shipped, some cases may require refinement with additional clear aligners to achieve ideal results. There may be additional costs to you if you require such procedures. Always follow the directions for use (included with each aligner package) for best results.

Informed consent & agreement
I have read and understand the content of this document describing considerations and risks of clear cosmetic aligners. I have been sufficiently informed and have been given the opportunity to discuss this form and its contents with my dentist, and to have my questions adequately answered. I have been asked to make a choice about my treatment, and I hereby consent to receive treatment for clear aligners treatment with SmileClub. I agree to follow my dentist’s treatment exactly as s/he plans, prescribes and provides it for me, and I understand that any questions, concerns or complaints I have regarding my treatment must be communicated to my dentist as soon as they arise.

I acknowledge that neither my dentist nor SmileClub, its employees, representatives, successors, assigns, or agents, have, can, or will make any promises or guarantees as to the success of my treatment or give any assurances of any kind concerning any particular result of my treatment. I understand that SmileCLub does not practice dentistry or give medical advice. I understand that SmileClub manufactures medical devices based on instructions from the prescribing dentist. I understand that I should always contact my dentist regarding my expectations, difficulties, results, or any other aspects of my treatment. I understand that it may be necessary to take impressions and/or photographs for diagnosis, professional review, and submission to SmileClub in order to create customised clear aligners for my cosmetic dental treatment. I recognize that these will be included in my medical records, which may include “personal data” as that term is defined and protected by the Data Protection Document. I consent to these medical records being disclosed to my dentist, other consulting dentists and orthodontists, and aligner manufacturers, some or all of whom may be located in the European Union and/or the United States of America, for the purpose of treatment, payment, and health care operations. I agree to the transfer of my personal data outside the European Union. I further agree that my dentist and/or SmileClub may use my medical records for research and educational purposes, but only to the extent that no individual identifiers, including but not limited to my name or address, are used or disclosed.

I hereby consent to such uses and disclosure(s) as described herein. Unless otherwise permitted or required by law, other uses and disclosures of my medical records, including advertising or marketing by either SmileClub, shall be made only with my prior written authorization.

I hereby certify that I have answered the smile assessment questions truthfully and accurately to the best of my knowledge. I understand that SmileClub.com is for natural teeth, and that ankylosed teeth and dental implants will not move. I understand the risks of orthodontic treatment include, but are not limited to, potential loss of bone or gum tissue, loosening of teeth, shortening of tooth roots, and jaw dysfunction or discomfort. SmileClub align the top 6 teeth and bottom 6 teeth as part of aligner treatment. These are considered your ‘social 6’ in dental terms. Chronic usage of anti-inflammatory medications, aspirin, estrogens, or calcitonin may slow or limit tooth movement.

I hereby certify that I have been examined by a licensed dentist within the past year, have received a thorough dental cleaning in the last six months, and do not have any of the above conditions or any other condition that may affect my medical or dental health or ability to be treated properly.

Additionally, I understand that I have been advised by SmileClub.com, that my best health interest would be served by having an orthodontic consultation by a licensed dental professional before purchasing any dental aligner or positioning system. I certify that I am over 18 years of age and do not wish to have an “in person” orthodontic evaluation before purchasing the SmileClub Aligner treatment. In the event that I do not proceed with treatment due to a contraindication or treatment or any other medical reason, I will seek care and follow up with my regular dental professional.

I have read and understand SmileClub Terms and Conditions and agree to be bounded by them. I accept that the predictive positioning is an estimated position and I am not guaranteed to achieve these results. I agree to wear a SmileClub retainer for 22 hours a day, for 6 months, followed by indefinite use of the retainer at night, to maintain the results of my treatment and promote healing. I agree to enter into this aligner treatment with SmileClub and will not hold SmileClub, any supplier, or any member of staff responsible for my medical or dental health.

Clear aligner therapy is unpredictable. SmileClub does not guarantee a successful treatment outcome. Individual results will vary. SmileClub warrants that its products: (i) shall conform to the specifications represented in the treatment setup approved by the dental team; and (ii) are free from defects in material and workmanship. SmileClub shall not be liable for: (i) any defects that are caused by neglect, misuse, or mistreatment of its products by the doctor, patient, or any third party; (ii) any defects that are caused by failure to follow directions including (but not limited to) wearing aligners out of sequence not wearing aligners for the entire duration of the specified wear schedule, or wearing aligners for less than 22 hours per day; (iii) any products being used in combination with other third party products. Cooling off period: Aligners are considered a medical device and are therefore a customised product and are exempt from cooling-off period. Disposing of clear aligners: Patients are warned not to throw out any clear aligners until they have completed their treatment and are also warned to keep the final clear aligner before their retainer in the event the retainer breaks. If you need to remake your impressions, we’ll send you another Modeling kit for £25/€25/$25.
